Terms and conditions

This translation is for information only. The binding version is the Czech text of these terms; in case of any discrepancy, the Czech version prevails.

These terms apply to entries for the races and events of the Cykloman series and to the payment of entry fees. They are written to apply to every race in the series – whatever a particular race does differently is stated in its race instructions, which take precedence over these terms.

1. Organiser

The organiser and contracting party is TJ Slovan Moravská Třebová, z.s., company ID (IČO) 43508511, registered office at Nádražní 1145/12, Předměstí, 571 01 Moravská Třebová, Czech Republic, registered in the public register of associations. The races of the series are run by its cycling section CK Slovan Moravská Třebová.

The organiser is not registered for VAT. The entry fee is the final amount; a receipt for the payment received will be issued on request.

The organiser may entrust the running of an individual race to another party – for example a partner of the series or an individual. The party running a race is stated in the race instructions. This does not change the fact that the contracting party is the organiser named in the first paragraph, unless the race instructions state otherwise.

2. Entry and formation of the contract

Submitting an entry creates a reservation of a place, not a contract. The contract of participation in a race is formed by payment of the entry fee.

When that happens depends on the method of payment used by the race:

The confirmation e-mail is a summary of the entry and an instruction to pay. It is not a confirmation that a contract has been concluded, nor a promise of a place on the start line.

For races paid on the spot, an online entry therefore binds neither party: the rider need not turn up and pays nothing, and the organiser holds a place for them until registration.

3. Entry fee

The amount of the entry fee, the closing date and any different rates for late entries are set out in the instructions for each race. The rate may differ by category and by when the rider entered.

The entry fee covers the running of the race, in particular the race number and chip, timing and processing of the results, refreshments at the finish and the prize giving. The scope differs from race to race; what a particular race provides is stated in its instructions.

The entry fee does not include insurance for the rider. The organiser arranges neither accident insurance nor liability insurance for damage caused by a rider. Each participant arranges their own.

4. Unpaid entry

If the entry fee does not arrive before entries close, the entry is removed. The rider owes nothing – no contract has been formed.

A removed entry does not appear on the start list or in the results in any form – not even as a non-starter.

If the settings of the race allow it, the rider may enter again on the spot at registration, at the rate applying to entries on the spot.

An entry fee received after entries close is returned to the account it came from.

5. Cancellation of an entry by the rider

Until the entry fee has been paid, the rider can cancel the entry themselves using the link they received by e-mail.

A paid entry fee is not refunded. If the rider does not take part in the race, for whatever reason, they have no claim to a refund of the entry fee or any part of it.

The rider may ask the organiser to cancel an entry that has already been paid; the organiser is not obliged to grant the request.

This is a leisure service provided on a specified date, for which the law grants no right to withdraw from the contract within fourteen days (Section 1837 of the Czech Civil Code).

6. The race does not take place

If a race does not take place for reasons on the organiser’s side or because of force majeure – weather, an official intervention, the organiser’s state of health and the like – the organiser will, at their discretion, either set a replacement date and transfer the entry fee to it, or offer to transfer the entry fee to another race in the series, or refund the entry fee.

If the alternative offered does not suit the rider, they are entitled to a refund of the entry fee. The refund must be requested within 30 days of the day on which the race was to be held, at the contact address given in article 10.

7. Changes to the course and the programme

The organiser reserves the right to alter the course, the timetable and the supporting programme of a race, in particular where required by the weather, the safety of participants or instructions from the authorities. In such a case the race is deemed to have taken place and the entry fee is neither refunded nor reduced.

This does not apply where the alteration changes the nature of the race so much that it is no longer the race announced in the instructions. Article 6 applies to such a case.

8. Rider’s declaration

By entering a race the rider declares:

  • that they are not aware of any obstacle in their state of health that would prevent their participation in the race,
  • that they have read the safety rules of the race and undertake to observe them,
  • that they take upon themselves full responsibility for any damage to health and property caused to themselves, to the organiser or to third parties before the race, during it and after it until its official end.

The rider signs the same declaration at registration. Entering online does not replace that signature.

The race is ridden at your own risk. Participants are obliged to observe the rules of the road and the instructions of the organisers; the organiser may exclude a participant from the race on safety grounds, with no claim to a refund of the entry fee.

9. Underage participants

An entry for an underage rider is submitted by their legal guardian. By submitting the entry the guardian confirms that they are acting for the minor and makes the declaration under article 8 on their behalf.

The declaration at registration is likewise signed by the legal guardian. Without that signature the minor does not start.

Because the race is ridden at your own risk, responsibility for the participation of a minor rests with their legal guardian. The guardian also judges whether the child is able to complete the race and whether they need an escort. The organiser recommends an escort for children under 15; it is not, however, a condition of starting and the decision remains with the legal guardian.

10. Complaints and contact

If a rider has any objection to a race, to the results or to an entry fee they have paid, they should contact the organiser:

  • by e-mail at info@cykloman.cz,
  • in writing to the registered office: TJ Slovan Moravská Třebová, z.s., Nádražní 1145/12, Předměstí, 571 01 Moravská Třebová, Czech Republic.

The contact person is Josef Doležel, chair of the CK Slovan Moravská Třebová section.

Objections to the results should be raised as soon as possible, ideally while still at the race and before the prize giving – afterwards the placings usually cannot be verified.

If the rider is a consumer and the dispute cannot be settled by agreement, they have the right to turn to the body for out-of-court settlement of consumer disputes, which is the Czech Trade Inspection Authority – Česká obchodní inspekce, Štěpánská 796/44, 110 00 Praha 1, Czech Republic, adr.coi.cz.

11. Personal data

12. Final provisions

Matters not governed by these terms are governed by Czech law, in particular Act No. 89/2012 Coll., the Civil Code.

The organiser may change these terms. The version in force on the day an entry was submitted always applies to that entry.
